Abbreviated Legal Description of tract 1: Parcel A in the NW ¼ of Section 23, Twp 98N, Range 44W of the 5th P.M., Lyon County, Iowa as shown by the plat recorded in Plat book 8 at page 7—except a tract of land in Parcel A in the NW ¼ of Section 23, Twp 98N, Range 44W described as follows: Beginning at the SW corner of Parcel A in the said NW ¼ thence N 320’ thence E 681’ thence S 320’ thence W 681’ to the point of beginning, subject to any public roads and easements of record. Containing 52.13 acres.

General Description: 

Tract 1: This tract contains 52.13+/– gross acres. This farm according to the Lyon County FSA contains 49.42 tillable acres with the balance in road and ditch. The predominant soil types of this farm include: 878, 878B—Ocheydan loam, 174B-Bolan loam, 91B-Primghar silty clay loam and 577B-Everly clay loam. The average corn suitability rating on this tract is 56.1. This farm is classified as non-hel. This farm has been tiled. This farm has a corn base of 33.9 acres with a direct yield of 104 bu and a cc yield of 133 bu and a soybean base of 25.1 acres with a direct yield of 34 and a cc yield of 40 bu. The corn and soybean base are combined with tract 1. The topography of the tract is level to gently rolling. A smaller parcel such as this is hard to find, so make plans today to attend.

Method of Sale: Tract 1 will be offered as 52.13 acres +/– and the bid held, then Tract 2-20.17+/–acres and the bid held. Then Tract 3 which will be a combination of Tracts 1 & 2. The land will be sold in the method which attains the highest value. If buyers desire boundaries to be verified, seller will pay for boundary survey. A new field driveway installation for access to either parcel will be the responsibility of the buyer(s)

Taxes: According to the Lyon County Treasurer, the current Real Estate Taxes are approximately $812.00 per year on Tract 1, $294.00 on Tract 2. Seller will pay the 2010 taxes due and payable in the Spring and Fall installments of 2011. 

Possession: Possession of the farmland will be March 1, 2011 due to current farm lease.

Terms for all tracts:  Purchaser(s) will be required to pay a non-refundable 10% of the purchase price immediately following the auction and also enter into a purchase agreement with the remaining balance due and payable on closing day December 29, 2010, when the buyer shall receive a clear and merchantable title to the property.
