METHOD OF SALE: Offered first will be Tract 1 then Tract 2 and then Tract 3 which will be a combination of Tract 1 and 2. Tracts will be sold in the method of highest value. If acreage site and farmland are sold separately seller will pay for abstracting and survey costs will be split 50/50 between buyers and seller.  

TAXES: According to the Lyon County Treasurer, the total current Real Estate taxes on Tracts 1 and 2 is $1660.00 per year. Taxes will be pro-rated to day of closing.

POSSESSION:  Possession of the acreage site if sold separately from the farmland will be on or before October 31, 2008. If acreage and farmland are sold as a unit, possession of acreage site will be December 30, 2008.  The possession of the farmland will be March 1, 2009

 TERMS: The buyer will agree to enter into purchase agreement with these terms. A 10% down non–refundable payment will be due on the acreage site immediately following the auction. The remaining balance will be due and payable on the acreage site on closing day October 31, 2008 –if acreage site is sold separately from the farmland at which time a clear and merchantable title will be given to the buyer(s). If the farmland is sold separately or if farmland and acreage are sold as a unit the terms will be as follows:  10% down day of auction and 40% due on December 30, 2008 and the remaining 50% will be due on January 2, 2009 The home/acreage are being sold as is where is with all defects and no warranties expressed or implied.
