Legal Description of Tract 1: The SE ¼ of Section 34, Logan Plat, Township 99 North, Range 47 West of the 5th P.M., Lyon County, IA., subject of public Easements, covenants, restrictions and conditions of record.

General Description of Tract 1:  Tract 1 consists of 160 +/– acres. According to the Lyon County FSA the farm has 158.4 tillable acres with a corn base of 106.4 acres and a direct and cc yield of 104 bu and a soybean base of 51.9 with a direct and a cc yield of 34 bu. This farm has a average corn suitability rating of 68.72. The predominant soil types include: 410B-Moody Silty Clay Loam, 910-Trent Silty Clay Loam, small portion of 92-Marcus Silty Clay Loam and 31-Afton Silty Clay Loam. This farm is classified as non-hel. According to the Lyon County FSA the farm has 77.2 cropland acres consisting of 72.9 tillable acres with a corn base of 68.6 acres with a direct and cc yield of 104 bu and a soybean base of 3.2 acres with a direct and cc yield of 34 bu. This farm also has 4.3 acres in the CRP Program until September 30, 2013 with an annual payment of $411.00 total. The predominant soil types of this farm include 410B, 410B2-Moody Silty Clay Loam and very small portions of 910B-Trent Silty Clay Loam and 401C and 410D2. This farm has an average corn suitability rating of 64.1. This farm is classified as non-hel and appears to be in a good state of productivity and well managed. Taxes: According to the Lyon County Treasurer, the current Real Estate Taxes on Tract 1 are approximately $2778.00 per year and on Tract 2 are approximately $1332.00 per year. Seller will pay the 2008 taxes due and payable in the Spring and Fall installments of 2009. 

Method of sale: Offered first will be Tract 1 and it will remain sold. Then Tract 2 will be offered and remain sold. Tracts 1 and 2 will not be combined.

Terms:  Purchaser(s) will be required to pay a non-refundable 10% of the purchase price immediately following the auction and also enter into a purchase agreement with the remaining balance due and payable as follows 40% of purchase price will be due on December 31, 2008 and the remaining 50% due on January 2, 2009 when the buyer shall receive a clear and merchantable title to the property. The farm is being sold as is as a cash sale with no finance contingencies.
